Terms of Service

Service conditions, certification mechanics, SLAs, confidentiality, balanced liability, and governing law for interpretation and translation services.

1. Scope of Services

These Terms govern services provided by Arkan Legal Translation, trading as Arkan Interpreters & Translators, under Dubai DED trade licence #1333628 and Dubai Unified Licence CJ9803. The services covered include:

  • Interpretation - court interpretation, conference interpretation (simultaneous and consecutive), medical interpretation, Remote Simultaneous Interpretation (RSI), interpretation equipment hire, and the Saudi Gateway interpretation service.
  • MOJ-certified legal translation - Arabic ↔ English under MOJ Licence #701, and other language pairs as described in Section 3.
  • Attestation routing - coordination of attestation steps through the relevant UAE and embassy/consulate channels; we do not represent any government authority and our routing service is administrative.
  • Arkan Go - fast-track lane for eligible routine documents, with service-level terms set out in Section 6.

Each tier has its own quote, scope and timeline; the quote describes which tier applies to your order.

2. MOJ Certification Statement

MOJ licensing in the UAE is personal, not corporate - individual translators hold the licence and bear personal liability for every certified document they sign. MOJ Licence #701 is held personally by Khaled Mohamed Abdeltawab Aladl and its scope is Arabic ↔ English only. Two routes are available for other pairs:

  • Other UAE-recognised pairs: handled by contracted MOJ-licensed translators, each operating under their own personal MOJ licence and signing their own certifications.
  • Pairs without UAE MOJ coverage: handled under Arkan company certification (DUL #CJ9803) by vetted translators bound by NDA.

The quality bar is the same across all routes. What changes between routes is the legal certification mechanism on the issued copy; we tell you at the quote stage which route applies and which authorities ordinarily accept that route. MOJ licence numbers of the signing translator are verifiable via the UAE Ministry of Justice 800 333333 hotline.

3. Ordering, Quotes, Confirmation

Quotes are based on the documents actually submitted - page count, language pair, complexity, certification route, and turnaround all factor in. If a sample is shared and the full document differs materially (more pages, handwritten sections, poor scan quality), the final price may adjust and we will tell you before proceeding. Quotes are valid for 7 days. An order is confirmed once we receive (a) payment or the agreed deposit, and (b) written go-ahead by email or WhatsApp confirming scope and timeline.

4. Document Submission Methods

  • WhatsApp - end-to-end encrypted by the WhatsApp platform; suitable for routine documents.
  • Email - encrypted email recommended for sensitive matters.
  • Operator-agreed secure channel - for higher-sensitivity files, Arkan agrees the intake channel with the client before work begins (e.g., the client's secure upload system, encrypted email, a controlled cloud folder, or another mutually approved channel documented in the SOW).
  • Physical drop-off by appointment at either registered office (The One Tower, Office 1302, Barsha Heights, Dubai; or Tower Plaza Hotel, Office 1204B, Sheikh Zayed Road, Dubai).

For high-sensitivity matters, the client may require execution of a Mutual NDA before any document transfer; a template is available on the Enterprise Resources page.

5. Document Requirements

For accurate translation we require:

  • Clear, legible copies of original documents;
  • Complete pages (partial documents may result in incomplete translations);
  • Indication of any specific terminology or transliteration preferences;
  • Notification of urgent deadlines at the time of ordering.

6. Service Levels (SLAs)

SLAs are explicit, not aspirational. Standard SLAs are:

  • Routine documents (birth, marriage, divorce, death, degree, transcript): 4–24 hours for eligible Arkan Go cases.
  • Standard legal translation: 24–48 hours.
  • Same-day legal translation: available where the Arabic ↔ English source allows and capacity is confirmed at order.
  • Complex or bundled matters: quoted with a custom timeline.
  • Enterprise contracts: bespoke SLAs (response time, escalation contact, named project manager) are set out in the enterprise contract.

The SLA clock starts once both payment (or the agreed deposit) and clear document copies are received. Where third-party events outside our reasonable control affect delivery - government office closures, court scheduling changes, system outages at third-party portals, courier delays - we will inform you immediately and propose a revised timeline. 7. Quality Standards and Acceptance Criteria

We deliver MOJ-certified legal translations that meet the published acceptance criteria of the receiving authority (including Dubai Courts, DIFC Courts, ADGM, GDRFA, MOFA, the UAE Ministry of Justice attestation chain, and other listed authorities). If a certified document is rejected for translation reasons attributable to us - that is, the rejection is for a defect in the translation itself, and not for source-document defects, authority-specific policy changes occurring after delivery, or matters outside the translation - we will revise and re-certify at no charge.

We translate exactly what the source document says - no additions, no omissions, no "improvements." If the source contains a typo or an incorrect date, the translation will reflect that faithfully. Where we identify a likely error in the source before work begins, we notify the client and the client decides whether to proceed; documented corrections to source-document errors may be noted on the translated copy on the client's instruction.

Marketing claims of speed, accuracy, or acceptance are subject to these Terms; in case of conflict, these Terms govern.

8. Source-Document Responsibility

Where possible we flag typos, missing pages, and illegible scans before work begins; the client retains responsibility for the accuracy and completeness of the source documents supplied. Where we identify a likely source-document error after work has begun, we notify the client and pause until instructions are received.

9. Confidentiality and NDAs

A mutual confidentiality undertaking applies by default to every engagement: each party agrees to keep the other's confidential information confidential, to use it only for the purpose of performing or receiving the services, and not to disclose it to third parties except as required by law or by these Terms. Enterprise clients may execute a separate Mutual NDA before work begins; a standard template is available on the Enterprise Resources page.

All Arkan staff and contracted translators are bound by NDAs of equivalent scope to any client NDA. File handling, access control, encryption, and retention follow the controls described in the Privacy Policy.

10. Subcontracting Transparency

  • Arabic ↔ English: handled by the MOJ Licence #701 translator (Khaled Mohamed Abdeltawab Aladl).
  • Other MOJ-covered pairs: handled by contracted MOJ-licensed translators; the identity of the signing translator on a given project is disclosed to the client on request under NDA.
  • Pairs without UAE MOJ coverage: handled under Arkan company certification (DUL #CJ9803) by vetted translators bound by NDA.
  • Vetting of contracted translators includes identity verification, credentials check, NDA execution, and a sample-test pass before any client file is released to them.

11. Payment and Invoicing

Payment is upfront for standard orders. Bank transfer and card payments (Visa, Mastercard) are accepted. All prices are quoted in AED unless otherwise stated. Enterprise clients with recurring needs may arrange monthly billing - net-30 by default; net-15 or upfront for new accounts pending account history.

12. Revisions and Corrections

If you identify an error in our translation, notify us within 7 days of delivery and we will fix it at no charge. Genuine translation defects (wrong term, missed line, incorrect rendering) are on us. Changes in terminology preference after delivery, additional pages, or revisions to the source document itself are new work and will be quoted separately.

13. Liability

  • Direct damages. Our aggregate liability for direct damages arising out of or in connection with any service is capped at the fee paid for the specific service that gave rise to the claim.
  • Indirect, consequential and loss-of-profit damages. Excluded in line with standard B2B practice. Enterprise clients may negotiate this allocation in a written enterprise contract.
  • Carve-outs that are not capped. Nothing in this Section limits or excludes liability for (i) fraud or fraudulent misrepresentation; (ii) gross negligence; (iii) wilful breach of confidentiality; or (iv) any liability that cannot be limited or excluded under applicable UAE law.
  • Enterprise contracts. Liability limits are negotiable in a written enterprise contract; professional indemnity insurance arrangements can be discussed on request.

14. Indemnification

  • Client indemnity. The client indemnifies Arkan against third-party claims arising from (i) inaccurate or unauthorised source documents supplied by the client, or (ii) unauthorised use of translations beyond the purpose disclosed at order.
  • Arkan indemnity. Arkan indemnifies the client against third-party claims arising from (i) Arkan's negligence in the performance of the translation or interpretation services, (ii) Arkan's wilful breach of confidentiality, or (iii) Arkan's infringement of third-party intellectual property rights in the act of translation (i.e., claims that the translation itself, separate from the source document, infringes a third party's IP).
  • Procedure. The party seeking indemnification will notify the indemnifying party promptly, allow the indemnifying party to control the defence (with reasonable cooperation), and not settle without the indemnifying party's written consent.
  • Cap. Indemnification obligations are subject to the liability cap in Section 13 above, except for the carve-outs listed in Section 13 which are not subject to the cap.

15. Data Protection

Personal data is processed in accordance with the Privacy Policy & Data Protection Notice and, where applicable to enterprise engagements, the security controls described on the Security page. A data-processing addendum (DPA) is available to enterprise clients on the Enterprise Resources page.

16. Cancellations

Cancel before we start working - full refund. Cancel after work has begun - we charge for the portion already completed. Rush orders have tighter cancellation windows because schedules are rearranged to accommodate them; those windows are stated at the time the rush is confirmed.

17. Force Majeure

Neither party is liable for failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of government, government office closures, court scheduling changes, civil disturbance, fire, flood, pandemic, network or power outages at third-party providers, or other events qualifying as force majeure under the UAE Civil Code. The affected party will notify the other party promptly and the parties will agree a reasonable revised timeline.

18. Intellectual Property

Upon full payment, the client receives the rights to use the translated documents for their intended purpose. The client retains all intellectual property in source documents and in the translations. Arkan retains no rights in the translations other than the MOJ-required retention copy held by the MOJ-licensed translator under the ledger duty described in the Privacy Policy.

19. Governing Law and Dispute Resolution

These Terms are governed by the federal laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. As an enterprise option, where both parties agree in a separate written contract, disputes may instead be referred to arbitration administered by the Dubai International Arbitration Centre (DIAC) under the DIAC Arbitration Rules, seat Dubai or DIFC as agreed. (DIFC-LCIA cases were transferred to DIAC by Dubai Decree No. 34 of 2021.)

20. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision is severed and the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy and any enterprise contract executed between the parties, constitute the entire agreement between the parties in relation to the services and supersede any prior understanding on the same subject matter.

21. Notices

Formal notices to Arkan must be sent to: Arkan Legal Translation, The One Tower, Office 1302, Barsha Heights, Dubai, UAE, with a copy by email to info@arkanlegaltranslation.ae. Notices to the client are sent to the email or postal address last notified by the client.

22. Changes to These Terms

These Terms are versioned by the "Last updated" date at the top. We update these Terms when our services or legal obligations change. Continued use of the services after a published change constitutes acceptance of the updated Terms; enterprise contract holders are notified in line with the contractually-agreed change-notification period.
